Squatters Rights

I had recently heard a radio program about this, In Atlanta it is a huge problem and growing exponentially and like your self...I wish someone could explain these "rights" to me, it is beyond mind boggling to me, how can the squatters basically have more rights than the property owners themselves and the law enforcement basically have their hands tied behind their backs when trying to remove or evict them form the property that is not even theirs. Then the property owners having to go through costly "legal processes" To have these people evicted from properties that they were never named in any rental or lease agreements. It just seems to me the non law abiding citizens and non citizens have more rights than the ones who do. And would someone please explain to me how we have gotten to this point?

From my understanding while it can be an issue anywhere, the more liberal the state is the more the laws benefits the squatters. I don't understand it that well either but it has to do with eviction laws and notice and time it takes to get them out. The more liberal the states tend to give the benefit of doubt to the squatters. With that said there are videos of people squatting on the squatters and basically forcing them to move out... Of course there is another government agency that will remove them free of charge. Even house them... I hear the rooms are a bit small and cool...

I could see this being a real concern for people with vacation homes. I hope someone can give more detailed info. I think it would be a good read...

this topic has interested me as well. Especially with vacation or second homes. From what I can see in the news it seems like the squatters have more rights which is insane. It's hard to believe what some people go through just to get their homes back. It's almost always a house for sale that isn't being lived in or one that isn't lived in full time. That's why my concern about second homes or vacation homes. I'm not one for more and more laws but I think this is an issue that HAS to be addressed in congress to put this issue to bed once and for all.

Property rights are one of the foundations to a free society. Initially it was "life liberty and property" instead of "life liberty and the pursuit of happiness." Squatters rights goes directly against that, which is why certain groups encourage it.

Yes, let’s hope they don’t figure out the vacation home thing.

I went thru this exact issue 8 years ago . Yeah it's real, and it's nothing new! Way, way over a century old. Many ways that they can put a Claim on someone property too! That sucks! This is Absolutely the Property Owners Obligation to not let this CRIME happen! Fact! Believe me I know! However, beware, as it takes Time, a Bad Person, and a Scandalous Attorney for someone to be to place claim on your property. This happens a lot too, don't think it doesn't! Just as we are all busy, and don't expect things like this to happen, it does. Especially not to you, eh. Contact a good Property Attorney Immediately, Pronto! I very well knew the people who tried this on me! My Property Survey once again richly rewarded me. Plus I had a Documented Lease Agreement on the property. Too long of story to get into, but pay Close Attention to what is going on with your property, always! You will be surprised what people will try and do. Even family friends for generations! A property Survey, a Valid, Documented Property Rental, or Lease Agreements are always absolutely needed! I never liked to pay for the Property Surveys that I have, however they always seem to be Rewarding to me in time. Good Luck on this Scandalous issue!

As Old Abe mentioned property surveys are expensive but invaluable. I had one don’t 2 years ago and after I was led to believe that one of my neighbors had more land than she thought it just proved a point. Her house is actually in violation and too close to the property line. I did not mention this to them but it’s a great card to have in my pocket. Plus it’s another document that proves you own the property. It’s sad but you have to have your documents in place for these very reasons.

Yeah, well, states being whatever, red, blue, upside down, or right side up has not caused, nor brought about this type bad thing to be happening. It has been around for a very long, long time. That is FACT. And tried to be used more years ago, than it is now. Different states have different laws about everything, and every issue. People need to be aware, and pay attention to whats going on that concerns them. Be responsible for what's yours! As it's not someone else's job!. Excuses are cheap, they don't work, and generally indicate being too late! Good luck, and always remember we don't live in a False Reality Fantasy Land. Wishful thinking is just that, Wishful, not Fact,

You are correct, it happens everywhere. My point was certain states tend to make is easier for squatters vs the owners. I think why were are seeing it more is just like everything there are more cameras and people sharing that information now. Ironically I think those same cameras keep people from handling it themselves.

Perhaps so, but you, as is everyone, are to be responsible for yourself, your belongings, and your property. No one is going to do it for you. And I wouldn't rely, or trust them anyway. As they could try squatting on your property that they are so called watching, eh! Like what happened to us,, 4 generation family friends, but not anymore! Like the military says, pay attention to your surroundings, your life may very well depend on it!

You had family friends do this to you? Wow... Bad enough for it to happen. Even worse when it should be someone you think you can trust.

Yeah, I had a long time tenant on the farm, with a 1 year, annual renewable lease. In other words it had to be renewed every year. As well as we always gave him the Registered mail legal notice also. Our families were very close friends for 4 generations. We always stated that any up coming year may be the last, as when our son decided he wanted to farm the farm he would. We actually gave him final notice 2 years in advance, ahead of time. He had let his son have a garden on part of one of the farm fields under the lease. After his final crop, the tenant became bitter about my son going to farm it instead of him. The next thing to come was my wife opened the mail one day and one of the envelopes contained a letter from a well known, and disliked Attorney stating that my prior tenants son had laid a squatters claim to the area where he had been gardening. Say what? He told us we could not contact the person placing the claim. Yeah, well, FU, eh! Naturally the legal fees started. Our Attorney immediately filed suit there of. Wasted time later, the Squatters claim was worthless, and trash canned. The documented lease, my survey, good records, and good sense prevailed. Having a good Attorney is absolutely adamant! Also having very good and Accurate records! Always! The survey on that same farm prevailed in us keeping our easement through someone else's property to access our landlocked back field. My grandfathers, grandfather was wise enough back in the early 1880's to establish, and secure a Prescriptive Easement. Done deal! I'm fortunate as my family for many generations has always kept good, accurate records. As in they had their --- together, eh!

My question on it has always been “at what point does it transition from trespassing to squatting?”.

When I was young my grandparents had 5,000 aces in northern WI. This meant that they landlocked many small lakes. The locals would have nothing to do with that so they made paths to access them. Gpa was fine with that and every 7 years post no trespassing and then make another path for them. This helped “hostile” “squatter” easement/rights to his property.

Sadly the locals rebelled and used the municipality to put fire lanes across his properties. W/in 10 years the locals regretted it as Mpls people moved in buying up tracts of land and “paved pardise”…..
