A Waupaca County judge earlier dismissed the charges, saying they contradicted the state hunting law. However, in a 13-page decision issued Thursday, the District 4 appeals court reinstated the charges and directed court officials to proceed with the prosecution of Rory and Robby Kuenzi.


Four deer were found dead along a snowmobile trail south of Waupaca in January 2009. A fifth deer had to be euthanized.


WLUK-TV reports a third man, Nicholas Hermes, also faces animal cruelty charges. Prosecution of Hermes was put on hold pending the Kuenzis’ appeal.

A Waupaca County judge had dismissed the charges, saying they contradicted the state hunting law. The appeals court, however, reinstated the charges and directed court officials to proceed with the prosecution of Rory and Robby Kuenzi.

Four deer were found dead along a snowmobile trail south of Waupaca in January 2009. A fifth deer had to be euthanized. A third man, Nicholas Hermes, also faces animal cruelty charges. Prosecution of Hermes was put on hold pending the Kuenzis' appeal.

Robby Kuenzi's attorney, Thomas W. Johnson, said he will petition the state Supreme Court to take the case. Rory Kuenzi is in prison for the 2004 hit-and-run drunken driving death of Kevin McCoy.

Fantastic!! at least the appeals court has some common sense. Thank those who are trying to lock these poor excusses for humans away.

Sad part is one of them is in jail 4 life 4 killing someone now we have 2 pay 4 him 2 go 2 court again. O ya innocent until proven guilty! We still r gonna have 2 pay.

Awesome, hopefully the charges will stick this time around. But on the other hand, I agree that it sucks to have to pay for these losers to eat and sleep under a roof!!!!
