BRP sues Arctic Cat for patent infringement

BRP filed lawsuits in Canada and the United States yesterday claiming that Arctic Cat has infringed various Canadian and American patents for the REV platform used in BRP’s lines of snowmobiles.

BRP claims in documents filed in the Federal Court of Canada and the U.S. District Court for the Northern District of Illinois that Arctic Cat knowingly used certain innovations protected by BRP’s patents, without permission. BRP is requesting that Arctic Cat halt production of the infringing models and destroy those in stock. The company is seeking monetary compensation for the infringement.

“In recent years we have seen our competitors attempt to copy an increasing number of our inventions and designs,” says Martin Langelier, vice president, general counsel and secretary. “Innovation being at the core of BRP’s strategy, we will not tolerate infringement of our intellectual property rights. We are, as a result, taking legal action to protect them.”

BRP introduced the REV chassis in 2002. The platform, the company says, allowed Ski-Doo to regain the No. 1 position in the industry, a lead it has since maintained.

The Montreal Gazette reports that BRP claims Arctic Cat infringed six patents on snowmobiles the company designed starting in 2003.

A BRP spokesperson told the paper that the lawsuit “would certainly [involve] thousands and thousands” of snowmobiles in Arctic Cat’s inventory.

According to the paper, the suit targets Arctic Cat’s 2007 Jaguar Z1 model in particular, but alleges that other models also violate BRP’s patents, including its 2008 Sno Pro 600 and TZ1 LXR as well as 2012 models.

A public relations rep for Arctic Cat told the paper that the company doesn’t generally comment on pending legal matters.

What are they going to do, take my XF turbo away from me and give me a skidoo instead? I think not.
Haveing any trouble with the turbo? Heard they are with the reverse and some leak issues. Heard they run like a beast though...

how about ski-doo with all those bad motors selling everybody short blocks with warranty expiring only last month so i had dealer install new motor and guess what same problems coming back in less than 500 miles so luckly someone bought the ski-doo rode ski-doos 96-2007 guess what i bought an arctic cat so far no problems and runs,rides alot better than all of my old ski-doos long story short if arctic cat needs anybody in court to stand by them and their product give me a call i bet ski-doo is real jealous of them building better snowmobiles oh yea this is a true story

Unless you are just the type that desires constant change, it sure seems like you went from the kettle to the fire.

well like i said ski-doo is the guilty one ripping off all of ther loyal customers as i was 15 years strong customer of ski-doo spending well over $100,000.00 when i had problems never could get any help from brp i'm finishing by saying to arctic cat keep building quality machines and stand by your customers you will not lose happy trails to y;all

Clearly they ALL have their problems, but I went through a fiasco with a Thundercat in 1994, with dealers, one after another that couldn't fix the simplest of problems, time and again, so I gave up. I swore I'd never buy another one, and never did. Never had anything close to what I experienced with that one, with many Poo's or Doo's, and now Yam.

they all have their problems? the ski-doos sure do from day one when bought brand new kept fouling plugs haven't fouled a plug on my arctic cat with over 1000 miles saving a lot of money now by not buying any plugs after all the plugs the ski-doo went through guess what motor blows after picking ski-doo on a spring order and getting in november of course the warranty didn't make it to december when the motor blew then installed by dealer machine failed had all the same problems and how was it my fault brought back to dealer they said nothing wrong got home and sled would not run right like i said luckly i sold the ski-doo just saying would love to see brp get sued for ripping me off and o yeah alot off other ski-doo owners had same problems resale value very poor on that ski-doo everybody i saw at shows knew about all of the problems the ski-doo's had wow read those brp brochures and it sounds so good best in class this and that no way!

Not terribly educated on this topic but it sounds like corporate ambulance - chasing. As long as litigators get paid, this will continue. Right or wrong has no dog in this race.

Doo 800 frozen crank & flaking rings left a bad taste in my mouth too! After 5 new doo 2s sleds you would think they could have done better than too bad buy a remanufactured 800 engine from us & good luck to ya. I might consider doo 4s 1200 but done with their 2s. Cat tried very hard to fix my 96 580 EFI EXT but was shocks, blown engine rode it & something different broke each time. I have had the best performance today with Yamaha 4s & Poo 2s a distant 2nd but Poo was back in early 90s.
