Family Medical Leave Act

Anyone know anything about Family Medical Leave Act? I work with someone that uses this at least once or twice a week. I'm wondering how much investigation can an employer do into this? By law does the employee have to show proof for everyday taken? My coworker uses the excuses that her mothers medication has been changed and she needs to be observed for 24 hours or she can't come in because she needs to pick up the medicine. This all seems like a huge scam to me. It seems to me that anyone not wanting to not come to work needs to use FMLA.
 
You may just not know all there is to know. It can be set up ahead of time with the company where when ever the person needs off, they use one more day. I work for a very large corp. and we have people on that all the time. Actually had one who worked for me that used it similiar to that.
Unfortunately, people do abuse it, but they usually get caught.

well if you see it the boss also knows what is going on and has them on a list of the first ones to go when it is time to trim the fat.

I have no doubt this girl is scamming the system. one example... the employee called into work to use fmla and thirty minutes later her mother calls looking for her. this crap with her has been going on for a long time. I have a feeling my employer just doesn't give a crap. I'm about to file a grievance as this is causing more work on a short staffed department.

I broke my wrist been out 5weeks this week and the FMLA dont apply to me!!less than 50 employees at my job!!!thats awsome!!she more than likely a dope head as thats the people the govt takes care of!!not the working man..

Once on it, it's very difficult for the employer to do much about it. Just keep in mind that those are likely non-paid days. The person can use their PTO until it's gone, but then have to take them without pay. The purpose of the law is to assist people who really have long term medical care issues with themselves or with family memeber, keep their job despite having to miss extended time because of it.

I'm with you guys, it gets abused ALL THE TIME. Saw it a lot back when I was on a huge project and we were hiring people off the street that were qualified only because they were breathing.... if you know what I mean.

I just looked into FLMA because my wife is almost due with our son. It is available to use, however there are conditions which must be met. I did not qualify because I was not at the job for 12 months yet, If I had been there 12 months, some of the other requirements were that you give 30 days notice if possible or FLMA can be denied. At my company it is un-paid, unless you have time off available, and there is a max of 12 weeks per year. I was told it does benefit the company and the employee to take time off using FLMA.

When used correctly (by the employee) and administered correctly (by the employer) FMLA can work out for both. For example - maternity leave or for a surgery with a long recovery time, but it can also be abused and when not done right.

FMLA may turn out to be one of those things that will be taken away by some employeers because of the few who abuse it. It only takes one to ruin it for all!

FMLA is a law (not sure if it's fed or state), so it's not something that can be 'taken away' from you by the employer......

It's a Federal Law. My coworker is out of control with it. I'd like to know how far a employer can investigate. I understand HIPPA would restrict what type of information can be given, but when this coworker shift starts at 6pm and she uses the excuse she's taking her mother to the dr or she can't come in because she is picking up meds. what dr is open that damn late and good lord, pick the meds up before 6pm. This homegirl doesn't want to work and she has found a good way to use the system to not come in.

I understand it is a federal law and will not be taken away. What I was trying to say was for the few that abuse it, it will make it that much harder to get and use for the people that actualy need it and use it properly.

and that my friend is why I would fire any one working for me that tried to get a union started.it is not about the individual but the collective and that works for lazy pos people great when guys with a good attitude and pride in the job get the same as the pos taking off and sticking you with her work .

i was out of work for two weeks for swine flu that turned into pnuemonia and put me in the hospital.the first 40 hours was either pto or no pay if i didn't have pto then the next 40 was covered 100% pay.

I'm a union firefighter. Does that make me a "lazy pos"?

It sounds like this person is taking days here and there. She can only take a total of 12 weeks. If your employer has less than 50 employees, I think they are exempt from having to offer FMLA. Employees are also supposed to fill out documents for every leave. I wonder if she is filling out paperwork for every day here and there. I know for my maternity leave, there were forms, doctor signatures, etc....

I hear ya- it's annoying when people abuse the system. I do the right things, I go to work, I pay my taxes, I pay for my medical care- and I'm getting nothing. Those that slack- get it provided for them by the gov't. It's a hard balance. I understand these programs were put in place to help people. Many of us/you may be utilizing some of these programs in our current, tough economic situation. That's fine. It's just a shame so many abuse it without care. I just tell myself that karma works in mysterious ways =)
