What Happened To The Deer Killers?

What was the legal outcome of the dirtbags that tied the deer to a tree & ran other deer down with their sleds last winter?

Did they put these gangsters in jail or least fine them many 1000s of dollars. Take their sled registrations away?

I also heard one of these criminals may have run a guy down with his truck after an arguement & killed him but could not be proven.

What happend?

Felony charges dismissed in snowmobile deer kill
By The Associated Press
Posted: June 12, 2009

Waupaca - Five felony charges of cruelty to animals have been dismissed against a man accused of running over and killing some deer with his snowmobile.

Robby Kuenzi's attorney convinced a Waupaca County judge Thursday that because the defendant was hunting at the time of the incident, state law prohibits animal cruelty charges.

Judge John Hoffman conceded and dismissed the felonies. Kuenzi still faces several ordinance violations and four misdemeanors, including hunting out of season.

Kuenzi's brother, Rory, and Nicholas Hermes face similar charges. Four deer were found dead along a snowmobile trail south of Waupaca on Jan. 10, and a fifth had to be euthanized.

Hunting out of season is called poaching in my book. Hang them. How can they get a lawyer evil enough to get them off? Tax payers again picking up the tab?

There is really something wrong with our legal system when they can get off because they were "hunting at the time of the incident" when hunting wasn't even in season. If hunting was out of season, how can that be used as a defense? I believe in karma and these guys will get what they have coming to them.

Don't blame the lawyers for doing exactly what they get paid to do....provide a defense for those guys no matter how lame it might sound. This is the United States of America, and you are entitled to a lawyer and the best defense possible.•••• is the law of the land....

What you should be mad about is that the current laws on the books don't provide for something like this and should make it a felony....specific to the events of this case.

If you run over a deer, in season, out of season, with a snowmobile, you should be charged with the specific offense.

Since there are no laws for this on the books, the clubs from this state should be pushing to have a law in-acted which would NOT let these dead beats go in the future. Like it or not, those who don't understand what happened, and that only these bums got off, will blame snowmobilers rather than...the idiot individuals themselves. All snowmobiling takes a black eye when events like this take place and it is your duty as fellow snowmobilers to push to enact laws to prevent it so that the tables get turned and snowmobilers become the ones who put teeth in a law preventing this in the future.

Lesson learned....close the loop hole and prevent it from happening again.

More laws? Seems to me the a-hole judge just tossed them in the trash. I mean how much more do you need? Trespassing, poaching, animal abuse, stolen property, etc. You can have all the laws in your imagination and what good are they? Maybe we need judges who aren't afraid of doing their jobs. And where was the prosecution on all this? Waupaca that lame that they can't handle a case that has national exposure?

1) Sad that my tax dollars went to get them off.

2) New laws to make it a crime to be a lame Prosecutor & Judge.

anonomoose: "If you run over a deer, in season, out of season, with a snowmobile, you should be charged with the specific offense."

I agree if it was intentional...but I'm sure I'm not the only person who has had a deer run across the trail in front of them at night and nearly hit it. In the daytime you may see them on the side of the trail but at night they are much harder to see.

The law could cover accidents...but that was NOT the case in the above charges. It was intentional, chasing across the field for them, and then running over it more than once.

Nobody in their right mind hunts deer with a car or truck, and the law should take that into account.

Intentional is one thing, accidentally is another...the cops/dnr have to have leyway on this, but they also have to have teeth and they didn't have any teeth to take care of this incident.

The snowmobile crowd need to force this issue and make sure this doesn't happen again.

There will be idiots in every crowd...managing those idiots takes some deliberate laws that can stick and that have teeth. Animal harrasement should not be the only thing that these fellows could have been charged with.

KNOW the laws, but HAVE THE LAWS to deal with this too.

The trail will be shutdown the last I heard. It was a lot, several miles. The club and landowner are on good terms, but she wanted it shut down and the club obliged her.

I agree with anon because every one does have an equal right. That being said these two idiots have a record a mile long, they should be brought out back, beaten with a hose then dragged down the street. It's sick what they did and unfortunately the charges were brought and the judge had to side with them.

I just can't believe it. I just can't. Makes me sick to my stomach. They should have the same thing done to them. HOW can they get off, I just can't get it threw my head. I just can't. You know they are laughing right now and all they learned was, another attorney will get me off the next time. The law isn't to protect the good people anymore, it is to protect the criminals. Next person will hit one by accident and do time!

I heard in our club meeting on Sunday night that these guys aren't off the hook yet. I haven't been able to verify it yet, but the information came from our county alliance. So, there is a little bit of hope yet that these guys will get what is coming to them.

They are not off the hook yet:
The Waupaca County District Attorney's office asked the state Attorney General's office to appeal that decision - wanting both the set of illegal hunting charges and the animal cruelty charges to stand. Wednesday, the Attorney General's office agreed to do so.

“We intend to pursue an appeal of the judges’ decisions because we believe the court erred in its interpretation of the relevant statutes," Attorney General J.B. Van Hollen said in a statement.

No court dates have been set for the appeals.

A third man, Nicholas Hermes, returns to Waupaca County court later this month in his effort to get the animal cruelty charges dismissed. The three allegedly ran down several deer with their snowmobiles, killing them.

Hooray for Van Hollen (WI Att'y General)!
I hope they take care of 'em in that ol' southwestern style, as seen in that old Pace Picante Sauce TV advertisement: Get a rope!

Waupaca (WFRV) – A man charged with running down deer with his snowmobile is expected to be charged with murder this afternoon.

Rory Kuenzi is also accused of killing someone in a fatal hit-and-run crash from 2004. Officials think Kuenzi hit Kevin Mccoy and then took off.

Rory Kuenzi was sued by Mccoy's family for the incident, but charges were never filed.

Waupaca County's District Attorney said he was waiting on a reliable reconstruction report of the crash before making a decision on whether to file charges.

The Attorney General’s Office says charges are coming today. The Attorney General will release a statement as well.

I hope he speaks about the federal animal cruelty charges his office is suppose to be appealing for these scumbags. Has anybody else heard anything regarding this? The last I heard anything was in July when his office decided to appeal the previous Judges decision.
