Lesson learned here is if you were to be stopped by an officer, leave your seat belt on until the officer approaches the vehicle and sees that it is in place.


Jeff, I'd fight it as well on principle.
 
I'd fight it. These d/bags are out there using petty bs like this as probable cause to get you on something larger. Hopefully a DWI. They have big stings on as you get closer to the holidays.

And that 10 bucks will seam small until you insurance company picks up on it and nudges your rates higher because they can. Then it becomes the gift that keeps on giving.

Fight it. Go into court and make sure you wear the coat. You dont need to hire an attorney.

Maybe he seen you on your cell phone, talking on the cell phone and driving is just unsafe, it should be illegal.

Unsafe maybe..........but NOT illegal, YET!!!!! Walking on my driveway after a snowfall is unsafe, think they should ticket me for that?!?!? NOT until its against the law,thank you.

As a former LE Officer.... I would plead not guilty, ask that the proscutor produce the officers in car video, which most state agencies require thier troppers to use on all traffice stops. Then when the judge see's the attitude of the officer, he will toss it faster than you can blink. I would then ask for a copy of the tape, take it to the State Patrol Post and file a conduct complaint against the officer.

I would fight it also. I rode to work with you for over a year and know you always wear your seatbelt. You also know that in WI the 1st seatbelt violation is $10, after that they just keep going up. I now work with a retired WI SP officer and he told me that all of there vehicles have on board cameras. He totally agreed with deputydog ask to see the tape, that camera is rolling when he is behind you to protect the officer if something bad happens during that stop.

Send them a check for $10 and 33 cents.... that will keep them busy for at least three weeks trying to figure out how to balance the budget with the extra 33 cents in there! They will have to send you back the 33 cents in order to balance their revenue and that will actually cost them more for postage!! haha!

Who knows you may get 35 cents because of interest. But then again you may get a packed of forms to fill out because of the over payment.

I am a "always go to court" guy when it comes to speeding tickets becuase most of the time if you are polite, apologetic and respectful they will drop the points and just want the money for the fine. Saves you money in the long run by keeping points of your record.

Is this a moving violation? Meaning will you get points on your record if the ticket stands? If there are no points involved I would just pay the ticket and move on.

This situation however seems like a terrible one to go to court on. Assuming you don't have any type of an eye witness that is going with you to back up your story it will be your word against the officers. He will say he definitely saw the shiney buckle of your seatbelt which wasn't on when he passed you and that you must have put the belt on as he was turning around. You will say you had it on all the time and he must have seen your jacket. The judge (or magistrate here in Michigan) will then be left to decide who was right. I'm not a betting man but I can tell you whose side I would expect him to be on.......

I'm not sure how things work in Wisconsin but you may want to look into court costs too. It would suck to go there on principal to fight a 10 dollar ticket and then end up getting smacked with 90 bucks in court costs for your time.




Also, while it's not as much fun as sitting around calling the cop a jerk that had nothing better to do and was bold face lying, do you think its possible he really thought he saw your buckle and was certain that you put it on after he saw you without it on? I'm sure he's seen that scenario play out dozens of times before and just thought this time was no different than any other. I know it sucks that he didn't just take your word for it but if he let every guy go that said "no I wasn't speeding" or "no I'm sure I came to a complete stop" or "I'm pretty sure the light was green" he wouldn't give out many citations.

A cop pulling a guy over and giving him a (gasp) 10 dollar ticket doesn't really seem like cop that was he** bent on being a jerk.

Really? he was going the opposite direction as I was . And didnt even have the balls to stand and discuss it with me. yes I understand that he must deal with alot of jerks, but I was being very polite and nice about my honesty and he just didnt want nothing to do with me.

To top of the situation I found out that the wife sent out the ticket with a check. So I guess Im just blowin' steam for nothing. I can never win!@#$%"&

i definately understand your feelings of wanting to fight it, but you probably just got off the cheapest way, last time they held me responsible for the cops time, the witnesses time.... didn't pay them much but added $135 to the bill I think it was
