I hate to say it, but I would agree.
So - You are on the job for two days and your boss wants you to do this??? Sounds like a test to me. And if it blows up it's your butt too. Oh well, they only have two days of training into you. I would quit this mickey mouse company and find somewhere else to work.

You would probably be able to sleep again. Business politics are not fun. Someone is going to go down. Dot your I's, cross your T's and start shopping.

This stuff eats me up. There are legal avenues around the whole deal but generally are not really cost effective for the average employee. Employers know this and continue. Start keeping a set of notes documenting conversation specifics and timelines. Handwritten is fine, but keep on documenting.

I'm telling you; put it back on HR by doing what I suggested. You will sleep better knowing you did the right thing, how can anyone fault you for making recommendations based on your 2 days in the position?? But remember don't let anything you have heard or seen prior to those 2 days affect your recommendation.

If the guy's not worth the extra $20k then get rid of him, it's already been said that he wasn't really performing, staying late don't mean sh_t if you're not getting something done. If he's the only one that can do his job he's worth the $20k and the company will be the loser when he walks as a result and the competitor will snatch him up
Age and seniority don't mean a thing, performance, performance, performance that what counts!
I was reading through to see how long it would take some one to bring up unions, figures!

If he was union they would just lay him off never to come back which they could still do.Sounds like they don't want him collecting unemployment checks either may be done with that just want him gone or converted to hourly. I would convert him to hourly & be done with it as things change in the workplace. At least he has a paycheck while looking for another job.

Just an update...stage one complete...I was able to tune it all out (for the most part) and look at it objectively. Turns out at least 10K of the initial 20k was not really an issue as he is really not doing the job as described in the rate/description he was assigned (legacy problem). I then came up with a structure based on specific job details which for the most part was not difficult either but it still took a little working out to get a solution that results in just under a 14k loss which still is a lot but in reality is fair for the current situation compared to others doing the basically the same job, yet he still will be above them in pay by a significant amount.

It seems like it has been accepted by HR & my boss as I did not get and negative feedback on it but I will see.

Stage Two will be implementing this with the employee and that will be interesting....

So he was reclassified to a job he wasn't doing due to his salary exceeding the scale of the job he really was doing? And you get to clean up the mess because the people who reclassified him no longer want to spend the money.

Looks like a good solution, good luck. Take a quick look through your staff to be sure their are no other people in this position, if so you may wish to treat them all equally, thus eliminating the age discrimination claim.
