Tailgater Video; who's at fault?

OK, here's your chance to be the judge and jury. This video was shot on Highway 41 in the Fox Cities just north of Appleton which is now part of the Interstate system in Wisconsin. If you've ever driven it you know it's fast and there's a lot of other people going in the same direction. Some of us are better drivers than others and some days you just have to shake your head at some of the bad driving out there.

So who's at fault here?

I should mention that no one was hurt, I would imagine just a few choice words and a change of underwear.

seriously....Guy or girl got what they deserved. Could have bad a real bad situation if he crossed into the southbound lanes...

BOTH AT FAULT!

Absolutely NO reason for the guy in front to stab the brakes like that. No matter how close the car behind him was.
The guy tailgating could have waited until there was actually room for the car in front to move over, before he started pushing.
The lead car was passing the vehicles in the right lane so it's not like he was cruising in the left lane blocking traffic.

Tailgater got off easy if it learned a lesson about what 78 mph @ 10' and closing, reaction time is.
While sweeperguys PC answer in "caps" is wrong, his explanation supports my conclusion.

I'd be willing to bet that if a Highway Patroller watching that was able to ID the jackwagon in the lead vehicle, and it resulted in a death, the driver of the lead vehicle would be looking at a charge of vehicular manslaughter.

Tailgater was way too close, and got off lucky.

Guy in front was fine where he was, he was going faster than car entering from on ramp and had every right to be in the left lane. Should he have hit the brakes hard, ehh, probably not. In this situation i usually tap the brakes quickly to give the tailgater a brief warning to get him to slow down. If that doesnt work, then he has had a warning, and the hard brake application is soon to follow.

How about this - I will drive on highways like I choose, watching in all directions and driving defensively (kind of like I do on snowmobile trails).

nope..he was startled..u jump on somebodys *** without expecting brakes..u deserve what u get..i just drove from mn thru wi to ill..after reading all the threads..and realize everybody in the left lane is an *******...so get the fk over..i expect brakes when i push u

The brake checker is a moron, simple as that. That's just asking for trouble. Where they thought they would be the aggressor, and check their brakes, there was MORE than enough room to move over, as they clearly did as soon as the other driver lost it.

Just move over and let the faster car go people, its not a race, there is no reason to block someone. They will get their due down the road when they miss that guy with the pretty blue and red lights sitting in the median.

Also, the driver tailgating is clearly not as good as a driver as they thought they were. IF you are going to ride someones ***, you have to be prepared for the moron that thinks they are more important and tries to control traffic flow.

Speeder was wrong, brake checker was wrong, had speeder NOT hit brakes as he did, this could very easy have been a major pile up accident of sorts, and who knows what innocent driver could have been hurt or killed,
Had speeder crossed into traffic on other side, a head on, is a BAD accident.
Yes tailgater was out of line, but like I said in other tread, two wrongs don't make a right!
poor decisions on both drivers here IMO

can't believe this is a debate. hit the brakes so somebody heads off to kill innocents in on coming traffic, someone thinks that's the way to go. lesson learned at 75 MPH! acting like a couple of first graders in charge of drivers ed class. both at fault

There were three other vehicles in the video including an 80,000 pound semi truck that didn't crash. Do you know why? Because they weren't tailgating and left enough space to stop in an emergency. AND they were in full control of their vehicles.

personally, frnash...I think you need to get out there and tail gate a state patrol cruiser like in the video and get back to us on how that worked out for you!

how could anyone ever tailgate you, mr autobahn??....LOL

Tailgater at fault. Both idiots! Silver lining is nobody else got injured or killed....and I doubt either of these two idiots will try this again soon.

Sometimes getting punched in the mouth is the only way to get through to ppl.....I bet it is a long time til the mouth punched, ditch diver tailgates like that again.



I know where the tailgate defenders are coming from, I think they might be mostly ticked off at the situation we've all seen where 2 side by siders that pace each other for miles and miles and block both lanes....everyone hates that, but clearly, with the merging traffic the guy getting tailgated wasn't doing that and if the tailgater had not been such an absolute azz crawling richard, none of this would have happened.

Sorry to the pet owners to have to say this (I am a pet owner also), but please, DO NOT brake for a lost puppy on a freeway if you are in traffic, or have someone tailgating. Do your best to avoid but don't endanger the other drivers on the road.
