Non violent potheads?......LOL......

WAUKESHA COUNTY -- Charges have now been filed against 57-year-old Philip Holland of Waukesha in connection with the death of 45-year-old Timothy Minkley.

Minkley was found dead inside his one-bedroom apartment near Wisconsin and Maple in Waukesha on Monday evening, September 14th.

Holland now faces the following charges:
•First degree intentional homicide
•Misdemeanor theft
•Possession of illegally obtained prescription

A criminal complaint filed in this case indicates officials were dispatched to Minkley's home around 7:30 p.m. on September 14th following a report of an unknown problem. Minkley's uncle advised he found Minkley lying in a pool of blood -- not breathing.

Officials located Minkley dead in the living room of his apartment. The complaint says he had several wounds to the back of his head that appeared to have been caused by a sharp object.

The complaint indicates officials located a cell phone in Minkley's pants pocket that contained text messages between Minkley and Holland.

Officials spoke with a woman who indicated she is a former girlfriend of Philip Holland. She indicated Holland came to her home on the evening of September 13th (the evening before the homicide) -- stating that he "needed some weed" in order to "mend the fences with another guy." The complaint says Holland told the woman that "if the weed did not work, something else would happen."

The complaint says on the morning of September 14th, Holland called his former girlfriend and said: "If the police come and question me, I haven't seen him."

Holland's former girlfriend told authorities on September 15th, Holland told her he had seen Minkley the previous evening.

Authorities spoke with a woman who indicated she is Holland's current girlfriend. She said on September 14th, she and Holland were eating dinner, and he "seemed preoccupied." She indicated Holland stated that "she was going to hear about something on the news regarding a homicide in Waukesha." The woman said Holland told her the guy died from head trauma, and that Holland was only defending himself -- and that the other guy had "attacked him with a hammer."

Philip Holland was arrested on September 16th.

Holland provided a written statement and confession to authorities, according to the complaint.

The complaint indicates Holland stated that on the evening of September 13th, he went to Minkley's home and took some weed with him -- and that he and Minkley smoked together. Holland said Minkley was "acting goofy," and was upset with people.

Timothy Minkley

Holland then said he saw a hatchet near the front door of Minkley's home, and he grabbed it and slid it under the couch due to Minkley's behavior.

Holland told authorities he slept on the couch and Minkley slept in his bedroom.

The next morning, Holland told authorities Minkley woke up late for work and began to blame Holland for not setting an alarm. The complaint indicates Minkley was standing in the doorway of his living room -- reportedly holding a folding knife which was folded closed. Holland said he was standing face-to-face with Minkley, and he thought Minkley was going to hurt him.

Holland said he was holding the hatchet in his right hand, and he hit Minkley in the head with it, according to the complaint.

Philip Holland

Holland continued to hit Minkley with the hatchet, according to the complaint -- striking him "enough that (Holland) was sure he would die."

Holland told officials at one point, he went into "kill mode" and hit Minkley to ensure he was dead.

Then, Holland said he wrapped the hatchet in a cream-colored towel and left Minkley's home -- eventually throwing the hatchet into the Fox River, according to the complaint.

The complaint indicates when Holland was questioned about inconsistencies in his various statements to police, he "began to cry, stood up, hugged detectives and admitted Minkley never had a knife."

Holland said Minkley was "yelling and ranting" about it being Holland's fault he'd be late to work. An argument then ensued, and Holland claimed that Minkley had told him he should beat "Nicky's" brains out with a hammer -- pointing with his right arm towards the front door.

The complaint indicates the reason he initially claimed Minkley was armed because it would justify killing Minkley more than if Minkley didn't have anything in his hands.

The complaint further indicates pills that were found in Holland's apartment and in his vacuum cleaner matched pills Minkley had picked up from Walgreens in Waukesha on September 13th. Holland told officials he had given Minkley weed in exchange for the pills.

#1. Get some weed to "mend fences" with a friend

#2. Smoke it up, mend fence and go to bed at buddies house

#3. Buddy wakes up late for work and blames you, the fence mender, for "not setting an alarm"< What?

#4. Forget to smoke more pot to mend fence again.

#5. Eff the fence mending .....time for whacks to the pothead buddy with the hatchet.....YIKES!

I'm with ezra on this one. Let's start the tally.

Glad you found ONE today, how many alcohol stories can you dig up TODAY? There are so many, they aren't even news worthy anymore unless it involves a vehicle where multiple people die.

Go to the west coast if you want to find drug stories in the paper. Hardly ever hear of an alcohol issue, Meth and pot and heroin are on every street corner and now almost every house because a user can grow up to 4 plants.

Big crazy world outside the Midwest folks.

gee wally thanks for the update wish I had not lived such a sheltered life.
so are these issues u speak of have like 90% more to do with meth and heroine or the fact that people can grow 4 plants? what would your guess be?

cuz I got to tell u when I was growing up I spent every summer in AK and almost every one my old man knew had the legal 4 plants . just cant remember to many roving pot gangs out there or guys on the corner tweaking for a pot fix .
also spent many yrs on the west cost and we both know the decriminalization of marijuana was in full effect as early as the late 80s in CA. anything less than a oz was a no court just a fine.
grouping casual pot smokers in with meth heads and junkies is the same as grouping the casual drinker with wife beaters

Don't be so serious, doooood....I was just lumping pot smokers in with ax murderers. Just facts...according to the police report.....nothing more.

Oh yea, one more thing....

"In 2005, Jamaica had 1674 murders for a murder rate of 58 per 100,000 people. That year, Jamaica had the highest murder rate in the world. In November 2008, the Jamaican Parliament voted to retain the death penalty, which is performed by hanging."

Did you want a paypal address to send the 10g's?

TWISTED FACTS See you're the one that is twisting the facts, it's like you admit, your lumping pot smokers in with axe murderers. No facts at all that point to Marijuana being the cause of the murder. In fact since the doer is using pills, and not knowing what his choice of ingestion is, if he's crushing and smoking them, or mainlining them, he's much more likely to have a mental breakdown.

Part two of your post means nothing either. No indication at all that pot has anything at all to do with the murder rate in Jamaica. Many other social issues in that country that are way more likely to cause such a high murder rate. AND THATS THE FACTS. And in no way rationalizing the the situation, as you like to use as your fallback.

You still don't get it do you. The pot of today is not the pot of your AK days. The factory pot of today has 10x more THC, genetically altered and heavily fertilized. How does fertilizer taste when you smoke it?

I have a very close family member that smoked pot daily for 8 years. His personality changed, he became more aggressive, very insecure and 'a know it all'. With the help of family love and the grace of God, he has been off the crap for half a year now. The person we knew is back and the pot head personality is gone, hopefully for good.

Every pot head I know is a know it all, wonder what chemical reaction in the weed causes this? Nobody will ever convince me pot is a good thing. I have been to way too many funerals of old friends that were pot heads to convince me otherwise. The same holds true for excessive alcohol.

Have a nice day Spicoli.

Again oh it is Jamaica so what every on is smoking pot and committing murder ? that is funny the cultural probs in Jamaica go way deeper than a guy smoking a joint on a beach and going out on a murder spree. but I guess it is Jamaica so it must all be relate to the pot . witch by the way has not been a power player in the market for well over 20 yrs.

My uncle has been a cop in Denver for over 25 years..9 years on SWAT (during Columbine) and also a trooper on the roads, hes now been the firing range instructor for Denver P.D. the last 10, in his words "pot has really turned the tables, crime is up and sometimes its just a mess in down town with everyone walking around high as a kite".... we try not to talk about his work to much, as he comes home to Illinois to get away from work, so I didnt elaborate or ask questions, but I could tell it really wasnt good for the city..(in his opinion) thats just my take on it. I havent been there since they legalized it so I dont know first hand. I know thats a cops point of view, but my uncle is a down to earth no bull sh$t kinda guy. So, Ill just leave it at that

false....just like to see your facts? you know the "stats" not just your pops feelings

EZRA.....ARE YOU OK????.......

"Police in Ohio said they were called to a house by a man who complained he'd gotten too high smoking marijuana and found him lying on the floor surrounded by snacks.

The Youngstown Vindicator reports that Austintown Township police found the 22-year-old man curled in a fetal position on the floor last Friday, groaning and surrounded by Doritos, Goldfish crackers and Chips Ahoy cookies.

The newspaper reports that the man told officers he couldn't feel his hands.

Officers found a glass jar of marijuana and paraphernalia in the man's car after he gave them his keys. The man refused medical treatment and so far has not been charged with a crime.
