Almost 50 Snowmobile Citations Given During Derby Weekend

Stopping an entire group of 60 sledders would very likely constitute violation of this right.

FIRST year law student would know this.


Wow anonomoose....a member of the 60 sledders admitted that at least two citations for invalid registration stickers were written...not having a valid registration sticker clearly visible constitutes probable cause...maybe your first year law student missed that day.

Nope, quite the contrary...

But I'm tired of my favorite recreation activity continuously coming under attack because of the dumb azz stuff that a large number of riders continue to commit.

So if setting up checkpoints gets even a small fraction of them off the trail I'm all for it!

And if you set out each day on one of your trips with a valid registration, obey the laws of operating a snowmobile and don't drink and ride to the point of intoxication...I can't understand why your so against them.

Some of you want to view a check point as a violation of your constitutional rights....which is a weak argument at best (frankly if it were in fact a violation i have no doubt it would have been challenged in a court some where by now)...my experience is that those that typically ride on the edge of the envelope in following the current laws are the ones who are the most vocal about the existence of checkpoints. I've seen some people post that they believe there are enough laws on the books....which is likely true....but then you whine when someone wants to enforce them...and the reason we need to enforce them are mainly because of all the azzes who still believe it okay or even cool to get drunk and ride.

I was not in ER but checkpoints are illegal in Wisconsin under Wisconsin state statute 349.02(2)(a). I believe they are illegal in MI and MN as well. You can interpret the statute any way you wish but you cannot deny that it was put on the books for a reason.

349.02 (2)(a)
(a) Notwithstanding sub. (1), a police officer, sheriff, deputy sheriff, traffic officer or motor vehicle inspector may not stop or inspect a vehicle solely to determine compliance with a statute or ordinance specified under par. (b) unless the police officer, sheriff, deputy sheriff, traffic officer or motor vehicle inspector has reasonable cause to believe that a violation of a statute or ordinance specified under par. (b) has been committed. This paragraph does not limit the authority of a police officer, sheriff, deputy sheriff, traffic officer or motor vehicle inspector to make an arrest or issue a citation for a violation of any statute or ordinance specified under par. (b) observed in the course of a stop or inspection made for a lawful purpose. This paragraph does not apply to a traffic officer or motor vehicle inspector in the performance of duties under s. 110.075 (2).

Right. There are too many laws on the books. Why should someone invent new ones?

If you are not doing anything wrong, why wouldn't you mind being detained.

He didn't --miss a day-- and neither would a competent judge find that stopping an entire 60 sled group to get two registration violations probable cause.

Probable cause is SEEING a sled go by without stickers. Since the whole group got pulled over by this law enforcement team, if you think about it, that was NOT a very good "find".

If you pulled 60 cars and trucks over, you could write tickets to more than that for broken taillights, non-functioning brake lights, headlights, marker lights, safety concerns, cracked windshields, the list is long and there are lots of violations to be had over that number of investigations as a matter of course. This surely does NOT constitute probable cause, and that is one of the first things a law student learns.

That would be probable cause to stop the one's with no sticker, but not the rest. Guilt by association? Not in my America.

I didn't see DNR warden listed in that statute.

I agree with Skylar that it's the law follow it... and with all the sleds up at the derby weekend 49 has to be a small % of the total. This sounds like most are following the law, and I don't want the ones that are making the sport look bad up there anyway.

I Did,Need not say more Revman.I also do the same activities as you mention but I want my kids to enjoy them also in the future and their kids.I also would like to have my kids run my business in the future and with that Man in office at this time it looks doubtfull.His main goal is to control everything in your life by goverment control.Yes,The true Americans are sick of his b.s.Change is on the way(Mass.election is the start)God Loves You,Greg

Nope. I still don't. I see a bunch of people that didn't all have registration and were drinking that got pulled over because they didn't all have registration and some were drinking. Not because of politicians that I may have or may not have voted for.

I'm done. Go out and ride. The season is almost over, so get out and enjoy the snow well all crave and love.

Sorry for my rant REVman,Just crabby today.Think positive about the season we have a good 6 weekends left.Iwill be in the U.P. for 5 of them.

Listen, I've tried to remain civil in this exchange, but it appears the intellectual level is not sufficient to deal with the topic being addressed.

IDIOT......sorry, I slipped, nobody has a problem with the 2 people that got the tickets, they have a problem with stopping the OTHER 58, BECAUSE THEY WERE WITH THE TWO, that showed probable cause for search. Get it now?

In any book, this is violation of civil liberties as indicated (above) by the fourth amendment of our very own constitution. But it's the DNR (damn near russia), so I guess they don't apply or answer to anyone other than the other idiot Jim Doyle.


Possibly before you start preaching, you can get a better handle on the concept of logic, and constitutional rights?

Sorry for the rant also RUSSHOLIO.And your right he doesn't have a clue.Bottom line is we don't need more enforcement that is goverment controled.Just need more self control in which we instill in our children as was instilled by our parents.
